While reports claim Shaun was under the influence when he was arrested, sources told Entertainment Tonight that the 39-year-old had been sober for weeks and was cleaning up his act.

Weiss' manager previously confirmed the news to Page Six, saying that the "Ducks" star's sentence already began, and he remained optimistic about his life after he serves his jail time.

"He was arrested for intoxication only and no further criminal proceedings are desired at this time", a Facebook post from OPD reads.

Officers in Oroville, CA arrested Weiss on public intoxication charges but cut him a break. Weiss was arrested for being under the influence of drugs. In August of previous year, he was arrested for possession of suspected methamphetamine in Burbank, Calif., after being out of jail for just one week.

This was not Weiss' first brush with the law.

However he later went back behind bars when he was arrested for possession of suspected methamphetamine after reports were made of a suspicious male stumbling around near the Warner Bros. studio lot in Burbank.

Last year, Weiss was sentenced to 150 days in a local jail after he pled no contest to stealing $151 in merchandise at a Fry's Electronics store.
