Immigration Agents Detain Girl With Cerebral Palsy

Rosa Maria Hernandez was born in Mexico but has lived in the USA since she was three months old.

Hernandez, who was born in Mexico and has lived in the U.S. since she was three months old, was stopped at a Texas Border Patrol checkpoint while she was being transported from Laredo to Corpus Christi for a gallbladder operation. The agency also revealed that the Laredo Sector Border Patrol followed the immigration laws of the state.

The border agents allowed her to proceed to the hospital but her detention after the surgery has been criticised by opponents of US President Donald Trump's crackdown on illegal immigration, which was a major part of his election campaign a year ago.

Later, the New York Times reported that, according to relatives and advocates close to the case, agents took Hernandez to a facility in San Antonio where migrant children arriving to the U.S. from Central America are typically held. "When you're a mother, all you care about is your child".

Rosamaria's mother Felipa de la Cruz, 39, said she brought her daughter from Nuevo Laredo, Mexico when she was a child in the hopes of obtaining better treatment for her condition. It's especially true for immigrants like Rosa Maria, who live south of Border Patrol checkpoints, in the Rio Grande Valley, and must cross the checkpoints to visit a hospital farther north. She said she was able to talk with her daughter via a video conference on FaceTime and said the Mexican Consulate was aware of the situation and would follow up with Rosa Maria's situation.

The hospital didn't confirm whether agents were outside her hospital room.

Leticia Gonzalez, the attorney, says it's been hard explaining to RosaMaria Hernandez, who has the mentality of a 6-year-old, why she can't go home.

After surgery, federal agents refused to release her back to her family and deportation proceedings were begun against Rosemaria.

As the Times notes, it is "rare, if not unheard of, for a child already living in the United States to be arrested - particularly one with a serious medical condition". The shelter's staff had been expecting her when she arrived and promised a smooth transition but did not have copies of Rosa Maria's hospital discharge papers or access to her medical history, Gonzalez said.

"Border control escorted a 10-year-old girl and guarded her door like she posed some sort of threat", Dominguez said.

"I'm a mother. All I wanted was for her to get the surgery that she needed", Delacruz said.

Gonzalez, the family's lawyer, told reporters the government was ignoring advice from the girl's surgeon that she should stay with family members who were familiar with her disabilities and that she must see her doctor in Laredo within three days. "I told her she was only there because she was recovering".
