ICJ to hear case of India man sentenced for spying on Pakistan

"One is given to India to present its details and another to Pakistan and only one day is given in the public hearing and I expect the ICJ will give its verdict only tomorrow", he added.

The development came after India instituted proceedings against Pakistan, accusing the latter of "egregious violations of the Vienna Convention on Consular Relations" in the matter of detention and trial of Jadhav, and sought a stay on his death sentence. A Pakistani military court had sentenced Jadhav to death on espionage charges.

He maintained that law academics believe that India was just making a political move and it had "a very weak legal case". The ICJ found that it has no jurisdiction to entertain the application filed by Pakistan on September 21, 1999.

According to the press release put out by the ICJ, India would make its oral observations at the court before lunch on Monday while Pakistan would argue its case in the post-lunch session. The hearing will be "devoted to the request for the indication of provisional measures" demanded by India which include ordering Islamabad "to take all measures necessary to ensure that (Jadhav) is not executed" until the court has had a chance to consider the case in full. "Pakistan will argue before the ICJ that since appeals are available in Pakistan therefore the ICJ can not take up the case", a lawyer associated with finalising Pakistan's response said.

The neighbouring county has made a decision to question the jurisdiction of the global court in this matter.

"We have sent our recommendations to the Prime Minister's Office and the Foreign Office", Ausaf told the Pakistani newspaper on Friday.

Mr Ausaf who headed marathon meetings for two days, which were attended by the bosses of the Foreign Office and the law ministry, is expected to lead the Pakistan side before the ICJ.

Not everyone in India agreed that the appeal was the best course of action for India.

Former Indian Ambassador to Islamabad TCA Raghavan suggested it was too early to arrive at a conclusion.

"The ICJ will be told how India had misled the Court and ... the world", they said. "But the idea was to save a man's life and do everything possible", he said.
